Terms & Conditions

Customer Responsibility - You understand and agree that it is your responsibility to back-up data, software, information, or other files stored on your computer disks and/or drives before we begin our work. You agree that we will not be responsible under any circumstance for any loss or corruption of data, information, files, and/or software.
Any specific files or folders that need to be backed up or
transferred in the course of work are explicitly stated in
writing before the work begins. Failure by Beach PC
Solutions, LLC to move all files and folders established by
the customer due to failure of notice in writing are not at
Beach PC Solutions, LLC fault, and may deem further labor
charges to complete the file or folder backups or transfers.
Access & Authorization - We must have (1) access to your residence or business and the computer(s) and/or peripheral(s) to be serviced, (2) your consent and cooperation to enter your residence or business, (3) the presence of a person at least 18 years of age during the entire time on-site services are provided, (4) a safe working environment and work space, and (5) electrical power. If we determine that these conditions have not been met, we may deny services and assess a cancellation charge.
Time & Material Rates - Beach
PC Solutions, LLC charges a minimum of 1 hour and a maximum of 3
hours for labor to diagnosis problems. Additional labor charges
at our then current rates will apply to labor to fix problems.
We charge for our labor in 15-minute increments. Labor times
will be rounded to the nearest 15-minute increment. We bill for
mileage greater than 30 miles outside of the 23503 zip code. The
mileage surcharge builds at $1 per mile past the 30 mile service
zone. Estimates given do not include any unforeseen parts and/or
labor expenses required to complete the service call. Beach PC
Solutions, LLC reserves the right to assess any additional parts
or labor charges needed to complete the service call. Any
additional charges will not apply without the customers consent.
Return visits to complete a service call, such as installation
of an ordered part, will be subject to the normal hourly
upgrade/repair charges set by Beach PC Solutions, LLC, including
the one hour minimum charge, and any mileage if outside the
service zone.
Web Development - Web Development is offered nationally throughout the United States to clients. Clients will be mailed this work order and agreement to sign and return in acknowledgement that the final product is satisfactory
if they are out of area. Complete payment is due after the client and Beach PC Solutions, LLC reach a final product. Final product will not be released until payment is received. Web hosting and domain are not included in price, but can be upon client’s request.
Client also acknowledges that Beach PC Solutions, LLC is not responsible for updating or maintenance on the web site, unless a maintenance plan is arranged. Prices on maintenance plans vary based on client’s needs.
Warranties - Beach PC
Solutions, LLC does not provide warranties for parts. We pass
through to you all manufacturers’ warranties. We warrant our
labor for 14 days after the date of the completed service call.
You will be solely responsible for any customer provided parts
that are defective or incorrect. In the event the customer
provides incorrect parts, a 1-hour minimum charge will be
billed, as well as any additional labor incurred after the
proper hardware/software was provided. In the event parts
provided by us are defective or incorrect, Beach PC Solutions,
LLC will not charge the incorrect part to the customer, nor
charge further labor charges to install/configure the hardware
or software. Out of area mileage charges will always incur,
unless the recall is the fault of Beach PC Solutions, LLC. Our
labor warranties will be voided if the labor has been modified,
affected by malicious software, or has been affected by acts of
nature.
Recalls - Recalls
are defined as the same problem occurring within the 14 day
warranty. A recall will not apply to customer provided
hardware/software unless otherwise installed/configured
incorrectly. In the event the same problem does in fact
occur again within the 14 days, Beach PC Solutions, LLC will
further service the device at no additional charge to the
customer (unless the labor warranty has been voided), which
applies to both labor and mileage charges.
Privacy - Beach PC
Solutions, LLC respects the privacy of our customers. Any
data recovered or backed up will not be released or made
public. Beach PC Solutions, LLC will not open files unless
otherwise needed for proper diagnosis, repair, or
configuration. Any personal information, such as email
addresses, will be kept confidential. Beach PC Solutions,
LLC does not send out solicitation emails (SPAM) to our
customers, or provide our customers email addresses to
solicitors.
Off-Site Repair -
Off-site repair is available only after the technician has
completed an initial evaluation of the machine on the
service call and has come to the conclusion that diagnosis
needs further equipment or time not available on the
customer’s site. In the event that Beach PC Solutions, LLC
must take the device off-site for further diagnosis, a
customer’s signature on this repair order gives the consent
of the customer for their device to be taken with the
technician for further diagnosis. There will be no
additional fee for off-site further diagnosis beyond the 3
hour diagnosis limitation set forth by Beach PC Solutions,
LLC. However, if you are being billed for travel, the
mileage will continue to accumulate on the total bill for
device drop off. Payment will be due after device has been
dropped off at customer’s location.
Payment Terms - All
charges are due upon completion of services performed. Beach
PC Solutions, LLC only accepts check, or credit. Cash will
be accepted only if exact cash can be given for services.
Credit card/debit card customers will be e-mailed an invoice
within 48 hours containing an electronic invoice with an
inserted hyperlink where the customer can pay via secure
checkout. Customers using a check, please make all checks
payable to Beach PC Solutions. You will be liable to us for
all costs incurred in connection with the collection of any
past due amounts, including, without limitation reasonable
attorney’s fees and interest.
Limitation of Liability -
Under no circumstances will we be liable to you or any other person for damages, including, without limitation, any indirect, incidental, special or consequential damages, expenses, costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by Beach PC Solutions, LLC or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or network as a result of service provided by us.
